WORKOUT WARDROBE SWEEPSTAKES RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
Official Rules and Regulations:
1. To enter the Win a $1000 Workout Wardrobe Sweepstakes (the “Sweepstakes”), log on directly to click on luckypromo.com/Subaru within the e-mail message and complete and submit the online entry form as instructed. Sweepstakes starts November 1, 2006 at 12:01 AM ET and ends 11:59 PM ET on December 4, 2006. Only one entry per person/e-mail address. Subsequent attempts to enter made by the same individual by using multiple names or otherwise, will be disqualified. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Sponsors. By providing your email address, you grant Sponsors the right to send you commercial messages and share your address with others unless specified otherwise as indicated on the entry form.
2. All entries must be received by 11:59 PM ET on December 4,2006, when sweepstakes ends. Sponsors are not responsible for entries that are late, lost, misdirected, incorrect, garbled, damaged, or incompletely received for any reason, including by reason of hardware, software, browser, or network failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission. Sponsors are also not responsible for any typographical or other errors in the offer, the administration of the Sweepstakes or in the announcement of the prize. Sponsors, in their sole discretion, reserve the right to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of the rules. Entry materials that have been tampered with or altered may be void. In the event there is a dispute regarding the identity of the person submitting the electronic entry, the entrant will be deemed to be the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning the email address for the domain associated with submitted e-mail address. Sponsors further reserve the right to cancel, terminate or modify any promotion not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort and, in the case of cancellation, to award the prize from among all eligible entries received prior to cancellation.
3. One (1) potential Grand Prize winner will be selected on or about December 18, 2006, in a random drawing, held from all eligible entries received. Prize Package: Workout apparel, footwear and gear, approximate retail value not to exceed $1,000. Items will be selected by LUCKY Magazine based on winner’s size and style preference
4. Potential winner will be notified by phone or mail at Sponsor’s discretion. Potential winner may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (where legal) within 14 days of notification attempt or potential winner forfeits prize and an alternate potential winner may be selected. If potential winner cannot be notified or is unwilling or unable to accept the prize, an alternate winner will be selected in a random drawing. No substitution, exchange or transfer of prize except by Sponsors, in which case a prize (or portion of prize) of equal or greater value will be substituted. Acceptance of prize constitutes consent to use winner's name, city and state of residence, photograph or likeness, biographical information and any statements made by winner for editorial, advertising, publicity and television broadcast purposes without further compensation, except where prohibited. Prize won by a minor will be awarded to a parent or legal guardian who must sign and return all required documents.
5. Participants agree to be bound by these official rules and all decisions of the judges, whose decisions are final and binding in all respects. Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of the date of entry, except employees (and their immediate family members and/or those living in the same household) of Sponsors. Sweepstakes void outside the 50 United States and the District of Columbia and where prohibited by law. Subject to all federal, state and local laws and regulations. Income and other taxes, if any, and any other costs or expenses not listed as part of the prize, are the sole responsibility of the winner. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. In addition, any dispute relating to the Sweepstakes (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in the City and County of New York. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have. Sponsors are not responsible for errors in the administration or fulfillment of this Sweepstakes, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Sweepstakes based upon such error at its sole discretion without liability and, in the case of cancellation, to award the prize from among all eligible entries received prior to cancellation. All entries become the property of Sponsors and will not be acknowledged or returned.
6. By entering, participants release Sponsors and their respective parent companies, subsidiaries, affiliates, and agents and the respective directors, officers, employees, and shareholders of each of the foregoing from any and all liability for any injuries, losses, or damages of any kind caused by any prize of resulting from acceptance, possession, use, or misuse of any prize.
7. Use of Data. Sponsors will be collecting personal data about entrants online, including first and last name, street address, phone number, and email address, in accordance with its privacy policy. Please review the privacy policy at http://www.luckymag.com/services/privacypolicy.html. By participating in the Sweepstakes, entrants hereby agree to Sponsors’ collection and usage of their personal information and acknowledge that they have read and accepted the privacy policy.
8. Odds of winning depend on the number of eligible entries received. For the name of the winner, send a self-addressed, stamped envelope, to: A. Vognsen, Lucky, 4 Times Square, 6th Floor, NYC 10036, Re: "Subaru Sweepstakes" winner, after December 18, 2006 but before June 18,2007.
